This document sets out the general terms and conditions of contract (hereinafter, the 'Terms and Conditions') that govern the relationship between Promotty SL (hereinafter, 'Promotty') and customers (hereinafter, 'Clients') when contracting the products and services offered through the website https://promotty.com/ and the Promotty mobile application (hereinafter, the 'Platform').
Clients include both registered Businesses, who use Promotty to manage their loyalty programs, and End Users, who purchase and use offers, coupons, and benefits through the Platform.
Accessing the services and contracting any of the products or plans offered implies full and unreserved acceptance of these Terms and Conditions.
1. Purpose
These Terms and Conditions govern:
- The subscription of plans by Businesses.
- The purchase and use of offers, coupons, and benefits by Users.
- The participation of Businesses in food-related events and promotions organized within the Platform.
About participation in food-related events
Registration and participation in food-related events through Promotty requires a PRO Plan and, in some cases, prior registration with or without an additional cost, as determined by the event organizer. Promotty is not the organizer of the events unless expressly stated in the event description.
2. Registration and User Accounts
To use Promotty's services, the Client must register on the Platform by providing truthful and up-to-date information:
- Businesses: Must complete their business details and select a subscription plan.
- Users: Must register to access their coupons, purchase history, and exclusive benefits.
Businesses and Users are responsible for keeping their login credentials confidential. Promotty is not liable for unauthorized use of accounts.
3. Plans and Prices for Businesses
Businesses can choose from the following subscription plans:
- Free Plan: Limited access to Promotty features, with restrictions on promotions and customer data access.
- PRO Plan: Full access to all loyalty tools, advanced statistics, and unlimited promotions.
PRO Plan prices are shown on the Platform and may be updated without prior notice.
Subscription payments can be made monthly or annually.
Transaction Fees
Promotty charges a commission on all transactions made within the Platform, with a minimum of €0.50 per operation. This fee covers operational costs, including payment gateway and transaction processing fees.
Applicable commissions are as follows:
- Payments with European Economic Area cards: 10%
- Payments with UK cards: 12.5%
- Payments with international cards: 13.25%
4. Coupon and Benefit Purchase Process for Users
Users may acquire coupons, discounts, and other benefits on the Platform by following these steps:

Guest Checkout
Users may make purchases without registering on the Platform (so-called 'Guest Checkout'). This mode carries an additional 5% handling fee.
5. Payment Methods
Payments on Promotty can be made through:

Payments are processed by the Stripe payment gateway, so Promotty does not store banking data.

6. Billing and Automatic Renewals
- PRO Plan: The subscription will automatically renew at the end of the contracted period.
- Cancellation of renewal: Businesses may disable automatic renewal at any time from their user dashboard.
- No refunds are issued for already paid periods.
7. Conditions for the Use of Coupons and Benefits
- Each coupon has specific terms of use established by the Business.
- Purchased coupons are non-refundable, except in cases of transaction error or failure by the Business.
- Coupons may have an expiration date and cannot be used after that period.
8. Right of Withdrawal
For Businesses:
- Businesses may cancel their subscription at any time.
- They will not receive refunds for already paid periods.
For Users:
- Users may request cancellation of their purchase within 14 days, provided the coupon has not been used.
9. Data Protection and Privacy
Promotty guarantees the protection of Clients' personal data in accordance with the General Data Protection Regulation (GDPR).
Businesses and Users have the right to:
- Access their personal data provided.
- Modify, rectify, or delete their data.
- Manage their privacy preferences from their profile on the Platform.

10. Modification of the Terms and Conditions
Promotty may modify these Terms and Conditions at any time. Clients will be informed of the changes and must accept the new terms to continue using the Platform.
11. Applicable Law and Jurisdiction
These Terms and Conditions are governed by current Spanish regulations. Any disputes will be resolved by the competent courts of Spain.
